O governo de transição estuda levar a Comissão de Anistia de volta para o Ministério da Justiça. No governo Bolsonaro, o colegiado foi atacado constantemente e ficou subordinado ao Ministério dos Direitos Humanos.
Integrantes do governo eleito e interlocutores da área querem que as decisões da comissão voltem a ter o peso político do Ministério da Justiça. Sob a pasta dos Direitos Humanos com Bolsonaro, o colegiado anulou concessões de anistia já aprovadas e negou quase todos os pedidos.
No atual governo, a comissão teve como conselheiro um general que levava para as sessões o livro de memória de Carlos Brilhante Ustra, notório torturador da ditadura militar. O colegiado também tentou se desfazer de 17 mil obras de seu acervo, como mostrou o repórter Evandro Éboli.
