Companheiros,
Conforme divulgamos em nosso Boletim, edição 2102, de 07 de janeiro de 2019, o processo que nosso Sindicato entrou contra a Gerdau Previdência já passou por diversos Juízes e todos mantiveram a liminar de bloqueio de parte dos dividendos em favor dos trabalhadores que migraram de Plano.
Desde o início, o nosso Sindicato entende que esses dividendos foram gerados por todos os trabalhadores e, por isso, não colocou nenhum obstáculo no caminho daqueles que não migraram, permitindo que estes recebessem aquilo que era deles por direito.
A Associação dos Aposentados de Ouro Branco, no entanto, ajuizou um processo alegando que 100% dos dividendos deveriam ser repassados apenas para aqueles que não migraram, dizendo que iria recorrer até a última instância.
Ora, quando essa Associação diz que irá recorrer até a última instância, ela parece estar dizendo que sabe que irá perder.
E isso aconteceu recentemente, quando a Justiça entendeu que essa Associação não detinha legitimidade ativa para o processo acima citado, ou seja, que lhe faltava qualidade necessária para que pedido fosse juridicamente válido, admitido ou reconhecido.
Ainda não vencemos o processo, mas, temos a certeza que estamos no caminho certo!
Até hoje, a Justiça manteve nosso pedido de liminar, e retirou do processo aqueles que só queriam tumultuar.
