Pedido de revisão do FGTS fica ainda mais importante com novo aumento da inflação
O tema da revisão do FGTS (Fundo de Garantia do Tempo de Serviço) tem ganhado força nos últimos meses, especialmente com a alta da inflação no país. Para os trabalhadores que atuam com carteira assinada, solicitar a correção desses valores se torna mais importante a cada dia.
A ação tem como objetivo promover a troca da taxa adotada para corrigir o saldo das contas do FGTS. A Taxa Referencial (TR), usada atualmente para este fim, está zerada, o que gera perdas monetárias ao trabalhador.
No acumulado dos últimos 12 meses, a inflação no Brasil ultrapassa os 10%. É como se o dinheiro que está parado nessas contas estivesse “perdendo valor” com o passar do tempo. Por isso, a revisão busca trocar a TR pelo INPC ou outro indexador que considere esse aumento nos níveis dos preços.
Andamento
O Supremo Tribunal Federal (STF) é o órgão responsável por decidir se a troca ocorrerá ou não. O tema esteva na pauta da Corte há alguns meses, mas foi retirada sem previsão de retorno.
Contudo, a votação pode ocorrer a qualquer momento. Nesse sentido, é importante protocolar o pedido de revisão do FGTS na Justiça, uma vez que o STF pode decidir que somente que judicializou a questão terá direito a ter suas perdas repostas. Esse é inclusive um caminho bem possível, pois o governo não dispõe de verbas para custear a revisão de todos os trabalhadores.
Cálculo da revisão
O empregado que atuou entre 1999 e os dias atuais e tem interesse em saber quanto pode receber com a correção precisa acessar seus extratos do FGTS. Em seguida, basta acessar a ferramenta LOIT FGTS e fazer os cálculos.
Pedidos que envolvem até 60 salários mínimos (R$ 66 mil) podem ser feitos direto no Juizado Especial Federal (JEF), sem custos e sem a necessidade de contratar um advogado.
