A proposta traz cerca de 330 alterações no âmbito trabalhista, sendo algumas destas mudanças bem polêmicas.
O Governo Federal juntamente ao Ministério do Trabalho e Previdência pretendem aplicar mudanças nas regras do regime CLT (Consolidação das Leis do Trabalho). Neste sentido, a atual gestão do país encomendou um estudo visando promover tais alterações.
Conforme o divulgado até o momento, estão previstas no texto cerca de 330 mudanças, que incluem, alteram ou revogam regras estabelecidas na área trabalhista. Dentre as alterações a que mais traz holofotes diz respeito ao trabalho aos domingos, em virtude da polêmica que gira em torno deste ponto.
Ademais, o relatório também mexe em outro ponto delicado, que impacta diretamente os motoristas de aplicativo (99, Uber, etc.) Neste sentido, o vínculo empregatício entre estes trabalhadores e as empresas será distanciado, a medida que proposta prevê uma alteração na regulamentação da atividade

Trabalho aos domingos e proibição para motoristas de app na CLT
Em resumo, caso o texto entre em vigor, o domingo pode deixar de ser o principal dia de folga do trabalhador, de modo que a atuação no referido dia não gerará o valor extra, hoje pago aos funcionários. Neste cenário, o governo estipularia outro dia para a folga do empregado.
Segundo o governo, a mudança vem frente ao alto desemprego no país, dado que esta diminui a burocracia necessária para contratar empregados que trabalhem aos fins de semana.
Neste sentido, é preciso entender que atualmente o trabalho aos domingos já acontece, entretanto, para isto ser possível é preciso haver todo um processo burocrático que envolve uma autorização ou negociação coletiva. É justamente na extinção deste referido procedimento que a alteração impacta, de modo que o trabalhador deixará de ter a garantia a um domingo de folga por mês.
Em relação às mudanças para motoristas de aplicativo, atualmente, quem integra este grupo é considerado trabalhador autônomo, de forma que integram o regime CLT. No entanto, a atividade é regulamentada pela legislação trabalhista, algo que irá mudar caso a proposta passe a vigorar
Conforme o previsto no texto, a ideia é alterar na regulamentação da atividade, migrando esta da legislação trabalhista para o Código Comercial, assim distanciando o vínculo empregatício do motorista com a empresa.
A problemática é que esta medida vai à contramão do estabelecido pelo Tribunal Superior do Trabalho, o qual define os motoristas como funcionários de suas respectivas empresas. Sobre o assunto o advogado Maurício Godinho Delgado, ponderou:
“No caso, nós temos o quê? Primeiro, uma pessoa humana, executando um serviço de transporte de pessoas. E, de outro lado, essa pessoa só consegue realizar esse serviço porque existe uma entidade empresarial gestora extremamente sofisticada, avançada, de caráter mundial, a qual consegue realizar um controle minucioso da prestação de serviço. Esse controle é mais preciso do que o previsto originalmente na CLT”, diz Delgado
